The Secretary must set up an Energy Jobs Council. The Council will include representatives from the Energy Information Administration, State energy offices that serve on the State Energy Advisory Board, the Department of Commerce and its Census Bureau, the Bureau of Labor Statistics, and any other federal agencies needed to do the work. The Council must survey employers in the energy, energy efficiency, and motor vehicle sectors and analyze jobs and worker demographics. The analysis must count how many workers spend a substantial portion of their hours (as the Secretary decides) on regulatory compliance. The Council must use the survey method approved in 2016 by the Office of Management and Budget for “OMB Control Number 1910–5179,” with representative, stratified sampling and enough responses from each State and the same NAICS codes used in the 2016 and 2017 U.S. Energy and Employment Report. The Council must consult federal agency leaders, States, the State Energy Advisory Board, and energy trade groups as appropriate. Not later than 1 year after November 15, 2021, and annually after that, the Secretary must publish a “U.S. Energy and Employment Report” on the Department website with employment and demographic data, the average hours spent on regulatory compliance, and, subject to subchapter III of chapter 35 of title 44, the underlying data. The report must break down results by the listed energy, efficiency, and motor vehicle sectors, by technology/subtechnology/fuel type, and, subject to the Confidential Information Protection and Statistical Efficiency Act of 2002 (44 U.S.C. 3501 note; Public Law 107–347), by State, territory, the District of Columbia, and county.
