Title 42 › CHAPTER 163 — RESEARCH AND DEVELOPMENT, COMPETITION, AND INNOVATION › SUBCHAPTER III — NATIONAL SCIENCE FOUNDATION FOR THE FUTURE › Part G — Directorate for Technology, Innovation, and Partnerships › § 19116
The Director may use extra powers to run the Directorate. The Director can give awards like grants, contracts, cooperative agreements, cash prizes, and other transactions. The Director can name program directors who have expertise in the challenge and technology areas in section 19107 and who come from different places like industry and colleges. Program directors set research goals, hold workshops, gather ideas from colleges, nonprofits, and companies, link researchers with users (for example industry or labor groups), review project applications using the Foundation’s merit rules, and watch project progress. Program directors serve for limited terms that the Director can renew and may use different review methods, including peer review. The Foundation may run two hiring programs to bring top talent. One program can appoint up to 70 eminent science or engineering experts, with no more than 5 in administration or management. Up to 5 named positions may be paid up to 150 percent of the maximum rate for Executive Schedule level I (section 5312, title 5). Other appointees may be paid up to the senior-level maximum (section 5376, title 5). Those appointments generally last up to 4 years, but the Director can extend an individual by up to 2 years. Extra pay cannot make total annual compensation exceed the limit in section 104 of title 3. The second program can hire up to 70 highly qualified experts from outside the civil service in fields like business, design, entrepreneurship, and venture capital. Those hires may be paid up to the senior-level maximum, serve up to 5 years (extendable 1 year for national security reasons), and their extra pay is capped by section 104 of title 3; they may not get other bonuses. The Director may also use hiring authorities under section 3372 of title 5 to bring staff from other governments and organizations. Within 30 days after August 9, 2022, the Director must contract with the National Academy of Public Administration to study the Foundation’s organization and coordination, and the Foundation must review the study and brief Congress on plans to act on its recommendations.
