§1962b–2 Organization of Commissions

Summary

Each river basin commission must get organized within 90 days after the President says the commission is created, if money is available. The commission can end if the Council decides or if a majority of the States in the commission agree. When it ends, its property, assets, and records go to the right U.S. or State agencies. Studies, data, and other materials useful for water and land planning must stay available to all participants. State members pick a vice chairman who also serves as their chairman and speaks for the States with the federal members. Empty seats do not stop the commission from working and are filled the same way as the originals. The chairman and vice chairman can name temporary alternates. The commission should try to reach agreement on issues, but if it cannot each member may state their view. If lack of agreement prevents action, the chairman’s position for the federal members and the vice chairman’s position for the State members will be put on the record. If there is no by-law or agreement, the chairman, after talking with the vice chairman, has final say on meeting times, report deadlines, subcommittees, and other procedural matters.
