EPA must make safety rules to protect people and the environment from radioactive and nonradioactive hazards at inactive uranium mill tailings sites and at depository sites chosen by the Secretary of Energy. Those rules had to be issued by October 1, 1982, and should match Solid Waste Disposal Act rules when possible. The EPA must weigh health risks, environmental and economic costs, and other relevant factors, and may revise the rules later. For processing, possession, transfer, and disposal of byproduct material (as defined in the law), EPA had to propose rules by October 31, 1982 and issue final rules within 11 months after that. If EPA did not finalize those rules by October 1, 1983, the Commission takes over making and enforcing standards. Nonradiological parts must be consistent with Subtitle C of the Solid Waste Disposal Act. When EPA revises a standard, the Commission and authorized States must adopt the revision within three years for affected licenses. Before finalizing any rule, EPA must publish the proposal, give at least 30 days for written comments, and hold a public hearing with a transcript. EPA must consult with the Commission and the Secretary of Energy. Anyone seeking court review must file a petition within 60 days in the proper U.S. court of appeals, and the rule cannot take effect earlier than 60 days after it is issued. The Commission is responsible for enforcing the byproduct-material rules in its licensing work, and States with authority must enforce them as provided in the law. EPA’s authority under the Clean Air Act and the Federal Water Pollution Control Act remains unchanged. The Commission was not to enforce certain 1980 uranium milling rules before January 1, 1983, and must suspend or change parts of those rules within set timeframes if EPA proposed or finalized overlapping standards (suspension within 90 days after EPA’s proposal; amendment within 6 months after EPA’s final standards).
