The Commission can give licenses and distribute source material in the United States to qualified applicants for research and development described in section 2051, for research or medical therapy under section 2134, for uses under section 2133, or for any other use it approves to help science or industry. The Commission must make rules that set basic standards for issuing these licenses. The rules must look at the material’s physical traits, how much is given, and how it will be used, and how those things affect national defense or public health. The Commission may charge a reasonable fee for materials under the first, second, or fourth kinds of uses, must charge for the third kind (section 2133), and must write rules saying when fees apply, including whether the applicant is a nonprofit and the intended purpose. Fees are set under section 2201(m).
