§2093 Domestic Distribution of Source Material

Summary

The Commission can give licenses and send source material inside the United States to qualified applicants for four kinds of uses: research and development like in section 2051; research, development, or medical treatment under a license in section 2134; use under a license in section 2133; or any other use the Commission approves to help science or industry. The Commission must make rules that set minimum standards for issuing licenses. The rules must look at how important the material is to defense or public health by considering three things: the material’s physical traits, the amounts to be shared, and the planned use. The Commission may charge a reasonable fee under section 2201(m) for types 1, 2, and 4, and must charge for type 3. It must write criteria for when to charge for types 1, 2, and 4 and consider if the requester is a nonprofit and what the material will be used for.
