Courts cannot stop a licensee from using a patented invention when that use is allowed under section 2183(b) or 2183(e). If a court finds such use in a lawsuit, the payment due is the royalty fee set under section 2187(c) plus costs, interest, and reasonable attorney’s fees; if no fee is set the court must pause the case until it is, and the patent owner may sue in any court to collect unpaid fees and related costs.
