A license or the right to use or make special nuclear material cannot be given, sold, or otherwise transferred to another person, whether voluntarily or not, unless the Commission first gets full information, finds the transfer follows the rules in this chapter, and gives written approval. The Commission may allow a mortgage, pledge, or other lien on a licensee’s facility or on special nuclear material, whether owned now or acquired later. Creditors can enforce those claims in court, but they must follow rules the Commission sets to protect public health and safety and to promote the common defense and security.
