Lets an applicant for a nuclear plant operating license ask the Nuclear Regulatory Commission for a temporary license to load fuel, run tests, and operate at a power level the Commission sets while the final license is still decided. The first temporary license for a plant can only allow up to 5 percent of full thermal power. After that, the holder can ask to increase power in stages, as the Commission allows. The first request can be filed only after four items are on file: the Advisory Committee on Reactor Safeguards report, the NRC staff’s initial Safety Evaluation Report plus its first supplement responding to that committee, the NRC staff’s final environmental impact statement, and a State, local, or utility emergency preparedness plan. Each request must include sworn statements of the facts supporting it. The Commission must publish notice and give people 30 days to send statements for or against the request. The Commission may grant or raise a temporary license level only if it finds the law is met except for the pending hearing, there is reasonable assurance the public and environment will be protected during the temporary operation, and denying it would cause a construction-to-operation delay. The final-license hearing must be finished quickly. The Commission can suspend the temporary license if the applicant does not move the final license forward. Granting a temporary license does not stop anyone from raising issues later. Parties or hearing board members must tell the Commission if the temporary license terms are not being met. The Commission must adopt rules to reduce the need for these temporary licenses. The authority to issue new temporary licenses ended on December 31, 1983.
