DOE contractors and their employees who break rules about protecting Restricted Data or other classified or sensitive information can be fined up to $100,000 for each violation. Contracts must include terms that reduce the contractor’s fees or payments if the contractor or an employee breaks these security rules, with different levels of reduction for different kinds of violations. The same procedures and limits used for similar DOE civil penalties under section 2282a apply here, except for subsection (d) of that section. For certain listed entities, fines can’t be imposed until they sign a new or extended DOE contract, and total fines in a fiscal year cannot exceed the fees DOE paid that year.
