Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER II — GENERAL POWERS AND DUTIES › Part B — Federal-State Cooperation › § 247d–3c
Require the Assistant Secretary for Preparedness and Response to create regional guidelines for hospitals, clinics, and other health partners to handle big public health emergencies (including chemical, biological, radiological, nuclear threats, and new infectious diseases). The Assistant Secretary must work with federal health and safety officials (like CDC, CMS, HRSA, FDA, labor and veterans officials), other appropriate agencies, and State, local, Tribal, and territorial public health leaders, and finish the guidelines within 2 years after June 24, 2019 (by June 24, 2021). The guidelines must set up a regional system that groups facilities by what they can do and how many patients they can treat, link with existing local health coalitions, and tell first responders and supply partners about those capabilities. They must cover infrastructure, labs, staffing, blood and supply needs, rural and geographic issues, worker safety (PPE, waste, decontamination, care for those who handle remains), workforce training and mental health, ways to contain disease, coordinated triage/treatment/transport based on medical need (including cross-state moves), and the needs of children and other at-risk people. The rules must be posted on the HHS website without harming national security and updated as needed, including using reports under the Pandemic and All-Hazards Preparedness and Advancing Innovation Act of 2019. The Assistant Secretary must get input from hospitals, public health departments, care providers, labs, blood and tissue banks, and other experts. They must think about financial costs and possible incentives for organizations to follow the guidelines. The Assistant Secretary may give technical help with CDC and OSHA and may run a demonstration grant project to build regional surge capacity and specialty response, but that grant authority ends on September 30, 2023.
