Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER II — GENERAL POWERS AND DUTIES › Part B — Federal-State Cooperation › § 247d–7f
Allows the HHS Secretary, working with the Attorney General and the Secretary of Homeland Security, to hold meetings with people and companies who are making security countermeasures or qualified pandemic or epidemic products. These meetings can cover developing, making, distributing, buying, or storing those products. The Secretary must lead the meetings, let the Attorney General, Homeland Security, and the FTC Chair attend, give advance notice of topics, protect national security and company secrets, and cannot force anyone to reveal confidential business information. The Secretary must keep a full transcript, but parts can be kept secret for national security. Taking part in a meeting that follows these rules is not, by itself, a break of the antitrust laws, unless the resulting agreement is not later exempted. Any written agreement from these meetings must be sent to the Attorney General and the FTC Chair with explanations of purpose, terms, methods, and why cooperation is needed. The Attorney General, after talking with the FTC Chair and the Secretary, must decide to grant, deny, partly grant, or request changes within 15 business days (and may extend up to 10 more business days). Any exemption starts right away and lasts up to 3 years before renewal, but can only be granted if it won’t create a big anticompetitive effect beyond what is needed to ensure the product is available. Misuse of information is still subject to antitrust and other laws. The Attorney General and the FTC Chair must report to Congress not later than one year after enactment and biannually thereafter. The rules expire on December 31, 2026. Definitions: antitrust laws = federal antitrust law and similar state laws; countermeasure or product = the named security or pandemic products; covered activities = work on development, manufacture, distribution, purchase, or storage of those products (with specified limits like no price-fixing or market allocation).
