Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER II — GENERAL POWERS AND DUTIES › Part F — Licensing of Biological Products and Clinical Laboratories › subpart 2 — clinical laboratories › § 263a–1
Requires each assisted reproductive technology program to report every year to the Secretary through the Centers for Disease Control, starting 2 years after October 24, 1992. Reports must show pregnancy success rates for each type of assisted reproductive technology the program uses and must list each embryo laboratory the program uses, stating whether the lab is certified under section 263a–2 or has applied for that certification. The Secretary must define "pregnancy success rates" after consulting consumer and professional groups and after publishing the proposed definition for public comment. The definition must consider age, diagnosis, and other important factors, and must include at least two measures: live births divided by the number of ovarian stimulation procedures attempted, and live births divided by the number of successful oocyte retrieval procedures.
