Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER II — GENERAL POWERS AND DUTIES › Part P — Additional Programs › § 280g–7b
The Secretary of Health and Human Services must set up a Public-Private Partnership no later than December 23, 2022. The Partnership will include the National Institutes of Health, the Food and Drug Administration, and one or more eligible groups. Its job is to learn more about amyotrophic lateral sclerosis (ALS) and other rare brain and nerve diseases, speed research and drug review, and help develop effective treatments that improve patients’ lives. An eligible group can be a college or university (or a group of them) or a nonprofit organization under 26 U.S.C. 501(c)(3). The group must have experienced staff and ties to patients, be able to build collaborations and raise money, and help create and test tools, find disease targets, and improve clinical trials. The Partnership may accept gifts and grants, use them to support research (including phase 3 trials tied to investigational drugs that are the subject of expanded access requests under 21 U.S.C. 360bbb), and spend donated funds without more federal approval. It must also promise not to take funding for a project from a company that makes FDA-regulated products unless the project’s results will remain free from influence.
