Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER II — GENERAL POWERS AND DUTIES › Part Q — Programs To Improve the Health of Children › § 280h–4
The Secretary of Health and Human Services must set up a program to give grants that help run school-based health centers. Grants go to a school-based health center or its sponsoring facility that applies and promises not to use the money for services that federal, state, or local law does not allow. The Secretary must give preference to centers that serve many children eligible for Medicaid (title XIX) or the State Children’s Health Insurance Program (title XXI). Grant money can only pay for facilities, land, buildings, expansion, replacement, equipment, or similar capital costs. Grants cannot pay for staff or to provide health services. Congress provided $50,000,000 for each fiscal year 2010 through 2013, and those funds remain available until spent. The terms “school-based health center” and “sponsoring facility” are defined in section 2110(c)(9) of the Social Security Act.
