Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER III — NATIONAL RESEARCH INSTITUTES › Part H — General Provisions › § 289g–1
Lets the Secretary run or pay for research that uses human fetal tissue to try to help patients. The tissue can come from a spontaneous abortion, an induced abortion, or a stillbirth. The woman who donates must sign a written form saying she donates the tissue for that research, that she does not limit who might receive transplants, and that she has not been told who those recipients are. The doctor who cared for her must sign a written form saying that, for an induced abortion, the woman agreed to the abortion before anyone asked about donation, that the abortion’s timing or method was not changed just to get tissue, and that the abortion followed State law. The doctor must also confirm the woman donated as described and that she was told about the doctor’s interest, and any extra medical or privacy risks beyond normal care. The lead researcher must sign a written form saying they know the tissue is fetal, that it may come from an abortion or stillbirth, and that it was donated for research; they must tell other staff this; they will get a written acknowledgment from any transplant recipient before transplant; and they did not cause changes in the pregnancy termination for the research. The agency head must tell the Secretary that the doctor’s and researcher’s statements will be available for audit. Audits must be kept confidential, used only to check compliance, not published except when law requires (then identities must be protected), and not kept longer than needed. The Secretary may fund or do this research only if the work follows State and local law. Every year the Secretary must report to the House Committee on Energy and Commerce and the Senate Committee on Labor and Human Resources about the prior fiscal year’s activities and whether these rules were followed. “Human fetal tissue” means tissue or cells from a dead embryo or fetus after an abortion (spontaneous or induced) or a stillbirth.
