Anyone may sue the Secretary in a United States district court if the Secretary fails to carry out a duty under this part. The person must give written notice first and wait 60 days after that notice before starting the lawsuit. If the plaintiff largely wins on one or more important issues, the court can order the Secretary to pay litigation costs, including reasonable lawyer and expert witness fees.
