Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER X — TRAUMA CARE › Part B — Formula Grants With Respect to Modifications of State Plans › § 300d–18
Decides how much money each State or territory gets from the program each fiscal year, as long as Congress provides the funds. Each place gets whichever is larger: a formula amount or a minimum guarantee. The minimum is $250,000 for each State, the District of Columbia, and Puerto Rico, and $50,000 for the Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands. The formula splits the available allotment money into two parts. Eighty percent is shared by each State based on its share of the total U.S. population. Twenty percent is shared based on land area, but no State’s area counts for more than 266,807 square miles when doing that math. If money is not paid to a State because it didn’t apply, didn’t file a proper application in time, or said it won’t spend the full amount, that money is reallocated to States that are receiving payments. The reallocation is divided by each State’s share of the population.
