Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXIII — PREVENTION OF ACQUIRED IMMUNE DEFICIENCY SYNDROME › Part A — Formula Grants to States › § 300ee–18
The Secretary can make a State pay back money it got under section 300ee–11(a) if the Secretary finds the State did not spend the money the way the State agreed in its application under section 300ee–13. If the State does not pay back the money, the Secretary can take the amount out of future payments the State would get under section 300ee–11(a). The Secretary can also stop payment to a State for the same reason, but must stop if the State gives reasonable assurances it will follow the agreements. Payments cannot be stopped for a minor mistake. Before making a State repay money or stopping payments, the Secretary must give the State a chance for a hearing inside the State. The Secretary must quickly look into serious complaints that a State broke the spending rules. Each year the Secretary will investigate spending in several States, and the Comptroller General may also investigate. States and groups that get the money must let the Secretary and the Comptroller General review and copy records upon reasonable request. Investigators cannot ask for information that is not readily available or make unreasonable requests for how data are given, except during a court case.
