Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XI — HEALTH MAINTENANCE ORGANIZATIONS › § 300e–11
The Secretary can act if a health maintenance organization that got a grant, contract, loan, or loan guarantee under this program, or an HMO included in an employer health plan, fails to provide required services, fails to provide them the way the law requires, or is not organized or run as required. If the Secretary finds such a problem, the Secretary must send the HMO a written notice saying how it failed and ordering it to start fixing the problem within 30 days (or a longer time if the Secretary allows) and to finish fixing it within the time the Secretary sets. If the HMO does not start or complete fixes, the Secretary must give a chance for reconsideration and, if the HMO wants, a fair hearing. If the problem remains, the HMO will lose its qualified status for employer plans until it fixes the issues. The HMO must tell employers, employee representatives, and members in clear language why it lost that status. The Secretary will publish each such finding in the Federal Register and may also sue in the U.S. district court where the HMO is located to enforce compliance.
