Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXIV — HIV HEALTH CARE SERVICES PROGRAM › Part B — Care Grant Program › subpart i — general grant provisions › § 300ff–31a
Grants awarded in fiscal year 2007 and after can be obligated by a State for one year starting on the day the money first becomes available (the "grant year"). If, at the end of that grant year, money is still unspent from certain supplemental grants, the Secretary must cancel the leftover money and require the State to return any amounts already paid out. The canceled money is then reallocated by the Secretary as extra funds for future grants, subject to a rule that limits availability. For formula grants, leftover money at the end of the grant year is also canceled and must be returned unless the State asks, in writing before the grant year ends, for a waiver and says how it will spend the money, and the Secretary approves. If a waiver is approved, the State gets one more year (a "carryover year") to spend the funds. If still unspent after that year, the money is canceled and returned and then reallocated for future grants. The Secretary will reduce a State’s next formula grant by the same amount of any unspent balance (unless the balance was 5 percent or less). Drug rebate funds are not treated as part of these grant awards, and a State can ask the Secretary to count rebate spending as reducing its unspent balance. The Secretary may also choose to reduce future grants instead of canceling money and may let the State use that balance for the future grant; those reduced amounts are likewise reallocated as extra grant funds.
