Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXIV — HIV HEALTH CARE SERVICES PROGRAM › Part E — General Provisions › § 300ff–87
By September 30, 2008, the Secretary must create and send a severity of need index to the right committees in Congress. The index scores how much help people with HIV/AIDS need in each state or area. It uses several factors and multiplies them by the number of living HIV/AIDS cases so some cases get more weight. Different parts of the program can use different factors. When the Secretary sends the index, they must include how it was made and tested, an independent contractor’s review, and a description of community input. If the index was not sent in fiscal year 2007 or 2008, the Secretary must send a report for that year updating progress on getting client-level data, describing progress on the index (including method and community input), and saying whether the index can be ready before fiscal year 2009.
