Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXIV — HIV HEALTH CARE SERVICES PROGRAM › Part B — Care Grant Program › subpart i — general grant provisions › § 300ff–23
A State may use federal grant money to support local groups of health care and community organizations—called consortia—that work in areas hit hardest by HIV/AIDS. These consortia must be made up of public and nonprofit providers (or for-profit providers only if they are the only good options). The money must be used to plan, develop, and provide outpatient health and support services either directly or by hiring others. Services can include medical and nursing care, case management, mental health and substance abuse treatment, dental care, tests and monitoring, prevention of opportunistic infections, treatment education, rehab, home health and hospice, plus support like transportation, attendant or homemaker help, day or respite care, benefits and other advocacy, nutrition, housing referrals, and child and family services (including foster care and adoption). To get funds, a consortium must show it has identified the people and groups in need, especially those with less access to care, and that its service plan meets those needs and fits the State’s overall plan. Usually the consortium must act as the main coordinator of services, unless the State finds that different subgroups need separate arrangements. The consortium must include local agencies with a track record, consult public health agencies and community organizations when planning, plan family-centered care for children, women, and families, include people with HIV in planning, evaluate its effectiveness and cost, report results to the State, and address underserved communities. States must give priority to consortia already in certain federal HIV care projects, then to other existing consortia. Money spent through these consortia counts as support services, not core medical services, for reporting rules.
