Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXV — REQUIREMENTS RELATING TO HEALTH INSURANCE COVERAGE › Part D — Additional Coverage Provisions › § 300gg–112
If you get air ambulance care from a provider who is not in your plan’s network, your out-of-pocket share must be the same as if the provider were in-network. Any coinsurance or deductible is figured the same way and counts toward your in-network deductible and out-of-pocket maximum. The plan or insurer must send the provider an initial payment or a denial notice within 30 calendar days after the bill is sent. The plan must then pay the provider the difference between the out-of-network rate for that year and the patient’s cost-sharing (after applying any initial payment). If the provider and the plan disagree on the payment amount, they have a 30-day open negotiation window starting when the provider gets the initial payment or denial. If they still cannot agree, either side can start an independent dispute resolution (IDR) process in the 4-day period after negotiations end. The federal health agencies had to create one IDR process by not later than 1 year after December 27, 2020. A certified IDR reviewer is chosen, each side submits an offer within 10 days of that choice, and the reviewer picks one offer within 30 days of being chosen. The chosen amount must be paid to the provider within 30 days after the decision. The IDR reviewer must consider regional comparable payment amounts and certain factors like patient acuity, provider quality, vehicle type, population density, and past good-faith efforts to contract, but may not consider usual-and-customary charges or public payer rates. The government will publish quarterly IDR data starting in 2022, and each party pays a fee set so total fees match the program’s costs. Definitions: Air ambulance service — medical transport by helicopter or airplane. Qualifying payment amount — the benchmark payment used to compare offers. Nonparticipating provider — a provider not in the plan’s network.
