Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXV — REQUIREMENTS RELATING TO HEALTH INSURANCE COVERAGE › Part D — Additional Coverage Provisions › § 300gg–119
Health plans and insurers must not sign contracts with provider networks or service vendors that stop them from sharing provider-specific price or quality information with referring doctors, plan sponsors, enrollees, or people who could enroll. For group plans, they also must be allowed to get, electronically, de-identified claims and encounter data for each enrollee on a per-claim basis, including financial items (like the allowed amount or other claim payments), provider name and clinical role, service codes, and any other data in a claim. Both group and individual issuers may share the price or quality data with a business associate (as defined at 45 CFR 160.103) when doing plan design, administration, financial, legal, or quality improvement work, as long as they follow the privacy rules under section 264(c) of the Health Insurance Portability and Accountability Act of 1996, the Genetic Information Nondiscrimination Act of 2008, and the Americans with Disabilities Act of 1990. Providers or networks can put reasonable limits on how the information is publicly released. Each group plan and each issuer offering group or individual coverage must file a yearly statement with the Secretary saying they follow these rules. Nothing here changes existing state or federal privacy protections or reduces access to data allowed under the cited privacy regulations.
