Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXV — REQUIREMENTS RELATING TO HEALTH INSURANCE COVERAGE › Part E — Health Care Provider Requirements › § 300gg–131
Hospitals and freestanding emergency departments that are not part of your plan’s network must not bill you more than your plan’s cost-sharing amount for emergency care you get during a plan year beginning on or after January 1, 2022. The same rule applies to individual health care providers who are not in your plan’s network: they cannot charge you more than the copay, coinsurance, or deductible your plan requires for those emergency services, as set by the federal cost‑sharing rules. The word "visit" has the same meaning used in section 300gg–111(b).
