Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XII — SAFETY OF PUBLIC WATER SYSTEMS › Part C — Protection of Underground Sources of Drinking Water › § 300h
The EPA Administrator must publish proposed rules for state underground injection control programs within 180 days after December 16, 1974 and must issue final rules within 180 days after that proposal. The rules can be changed later. The Administrator must follow the normal federal rulemaking process (section 553 of Title 5), hold a public hearing before finalizing rules, and talk with the Secretary, the National Drinking Water Advisory Council, other federal groups, and interested state officials. The rules must set minimum standards so state programs stop injections that could harm drinking water. States must bar injections without a state permit (or allow them only by a state rule), require permit applicants to show injections will not harm drinking water, and include inspection, monitoring, recordkeeping, and reporting. The rules cover injections by federal agencies and everyone else. They cannot unduly block injections tied to oil and gas production, brine, or secondary/tertiary oil or gas recovery unless needed to protect drinking water. The EPA must allow for different geologic or local conditions and should avoid upsetting many existing state programs unless both rules cannot be followed. The EPA may let states issue certain temporary permits until four years after December 16, 1974 under specific conditions. “Underground injection” means putting fluids underground by well; it does not include underground natural gas storage or most hydraulic fracturing fluids or proppants (except diesel fuels). An injection endangers drinking water if it could put contaminants into water used by public systems and cause a rules violation or harm people’s health.
