Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XII — SAFETY OF PUBLIC WATER SYSTEMS › Part D — Emergency Powers › § 300i
When the EPA Administrator finds that a contaminant is in, or likely to enter, a public water system or an underground source of drinking water, or that a threatened or intentional attack could make drinking water unsafe and put people’s health at immediate risk, and state or local officials have not acted, the Administrator may do whatever is needed to protect people’s health. The Administrator must try to check with state and local officials when possible. Actions can include ordering steps to protect users (including travelers), making those who caused the danger provide alternative water, and starting civil court actions like restraining orders or injunctions. If someone disobeys an order from the Administrator, a court can fine them up to $15,000 for each day they keep violating it.
