Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XXVIII — HEALTH INFORMATION TECHNOLOGY AND QUALITY › Part A — Promotion of Health Information Technology › § 300jj–19
The Secretary must make sure health IT rules work with HIPAA privacy and security law and must build those privacy and security needs into the standards set under section 300jj–14. For this rule, "HIPAA privacy and security law" means part C of title XI of the Social Security Act (42 U.S.C. 1320d et seq.), section 264 of the Health Insurance Portability and Accountability Act of 1996, subtitle D of title IV of the Health Information Technology for Economic and Clinical Health Act, and the regulations under those laws. The Secretary can be flexible when deciding which kinds of health care providers count under section 300jj(3) for these rules. The Secretary must use existing powers to push health information exchanges and other groups to work with providers and plans so patients can get their electronic health information in one easy, secure, and updateable view. The Secretary and the Office for Civil Rights (OCR) must teach providers how to use exchanges, clear up misunderstandings, and name exchanges that meet these goals. They must issue guidance so patient data shared through exchanges is private, accurate, verifiable, and, when needed by law, easily shared with the patient’s permission. State laws that give stronger consent protections still apply. The National Coordinator and OCR must promote convenient access without overburdening providers. The OCR Director, with the National Coordinator, must help people and providers know HIPAA access rights and best ways to get data in computable form (like portals or apps). The National Coordinator may require certification rules under section 300jj–11(c)(5) to support patient access (one longitudinal view), patient-reported information, optional research access, and ask the HIT Advisory Committee to set needed standards.
