Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XV — HEALTH INFORMATION AND HEALTH PROMOTION › § 300u–12
HHS must set up a national public–private partnership and run a campaign to teach people how to prevent disease and stay healthy at every age. The campaign must share information on why preventive care matters, encourage healthy choices, promote services recommended by national prevention panels, explain what preventive services health plans through an Exchange cover, describe other CDC and related agency-supported care, and include general health tips. HHS must get scientific advice from the Institute of Medicine. Within 1 year after March 23, 2010, the CDC must start a national, science-based media campaign about nutrition, exercise, quitting smoking, lowering obesity, the five leading killers, and screening. The campaign must be paid through competitively awarded contracts, may use TV, radio, Internet, and targeted messages, must not repeat other federal efforts, and can use humor or well-known role models. It must be checked by an independent review every 2 years, with reports to Congress every 2 years. HHS must keep a website with science-based guidance, share materials with federal health programs, create a personalized prevention website and an Internet portal for risk tools, and give priority funding to these activities up to $500,000,000. HHS must also guide States on Medicaid obesity services and require States to run outreach for enrollees, with reports to Congress by January 1, 2011 and every 3 years through January 1, 2017. Funding may be appropriated as needed.
