Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XVII — BLOCK GRANTS › Part B — Block Grants Regarding Mental Health and Substance Use › subpart iii — general provisions › § 300x–55
The Secretary can stop, cut off, or end federal grant payments to a State if the State does not follow the grant rules. The Secretary can also make the State pay back money with interest that was not spent the right way. If the State does not pay back, the Secretary can take the amount out of future payments. The Secretary can hold back payments until the State shows it will follow the rules, and must stop holding back money once there are reasonable assurances the State will comply. For some specific grant conditions in the programs under sections 300x and 300x–21, the special penalty rules in those other sections (including sections 300x–1(d), 300x–4(b), 300x–26, and 300x–30) apply instead of these rules. Before doing any of these things, the Secretary must give the State notice and a chance for a hearing. If a complaint looks like it has reasonable evidence, the Secretary must quickly hold a hearing. If the Secretary finds the State is not following the rules, the Secretary must take appropriate action to make the State comply. Starting in fiscal year 1994 and every year after, the Secretary must investigate spending in at least 10 States to check compliance. States and any groups getting the funds must give records and documents to the Secretary or the Comptroller General when reasonably asked. The Secretary cannot start withholding payments under the holding-back rule unless a qualified, in-State investigation has been done.
