Title 42 › CHAPTER 6A — PUBLIC HEALTH SERVICE › SUBCHAPTER XVII — BLOCK GRANTS › Part B — Block Grants Regarding Mental Health and Substance Use › subpart ii — block grants for substance use prevention, treatment, and recovery services › § 300x–32
States must send their grant application to the federal health official by October 1 for the fiscal year they want money. The application must include the required funding agreements, a certification from the governor or top state official, assurances that the state will follow the rules, the report called for in section 300x–52(a), and a state plan that the federal health official approves. The state must also show it followed the most recent approved plan for the last year it got a grant. The application must be in the form and contain the information the federal health official asks for. The state plan must describe the care system and name the agency in charge, estimate how many people need services (including pregnant women, women with children, people with both mental health and substance problems, people who inject drugs, and people who are homeless), show how many are in treatment, list types of services and recovery supports, explain prevention and recovery activities and how money is spent, describe available funds and the workforce, say how the state uses evidence-based practices, explain how services link to primary health care, set goals and targets, and describe how the state will meet the grant rules and spend the money. The federal health official can ask a state to change its plan before giving a grant but cannot force changes during that grant year. Prevention parts are reviewed by the Center for Substance Abuse Prevention. For U.S. territories except Puerto Rico, the federal health official may waive some rules (but not section 300x–31). The federal health official had to set standards by August 25, 1992, and could not make grant payments for fiscal year 1993 on or after January 1, 1993, unless those standards were issued. States may ask for waivers of sections 300x–22(b), 300x–23, 300x–24, and 300x–28; the official must decide within 120 days and must report each year which states got waivers.
