Title 42 › CHAPTER 35 — PROGRAMS FOR OLDER AMERICANS › SUBCHAPTER XI — ALLOTMENTS FOR VULNERABLE ELDER RIGHTS PROTECTION ACTIVITIES › Part A — State Provisions › subpart iii — programs for prevention of elder abuse, neglect, and exploitation › § 3058i
Requires State agencies, working with area agencies on aging, to create and improve programs that stop and deal with elder abuse, neglect, and financial exploitation. States must use the money to run activities such as public education and outreach (including teaching financial literacy and preventing identity theft), building data and reporting systems, coordinating with adult protective services, law enforcement, courts, and long-term care programs, training caregivers and professionals, giving technical help to victim services, testing “safe haven” shelter models, and supporting team-based, multidisciplinary responses. The programs must protect privacy, let older people take part in decisions about their care, use the least restrictive options, and set up a public clearinghouse with information on problems, facilities, and help. States must promptly investigate reports of known or suspected abuse and take steps to protect victims. Participation in services cannot be forced. Records stay confidential except with written consent, when shared with law enforcement or protective agencies, or by court order; States should use narrow memoranda of understanding to resolve confidentiality issues. A State can name an agency to run these programs. The Secretary must study financial exploitation with other federal and state officials and report to Congress within 18 months after November 13, 2000. The Assistant Secretary will create accountability measures and evaluate the programs (using funds under section 3017(h)). Entities getting funds must follow all applicable laws and rules.
