Title 42 › CHAPTER 38 — PUBLIC WORKS AND ECONOMIC DEVELOPMENT › SUBCHAPTER II — GRANTS FOR PUBLIC WORKS AND ECONOMIC DEVELOPMENT › § 3154g
The Secretary may give grants to eligible recipients to build, extend, or improve high-speed internet service. "Broadband project" means planning, buying land, or building and fixing facilities and related equipment. "Eligible recipient" includes public-private partnerships and consortia set up to provide or improve broadband. "High-speed broadband" means two-way internet fast enough for people to take part in the economy, as the Secretary defines. When deciding awards, the Secretary must try to spread grants across different places and consider underserved areas. The Secretary will ask the Federal Communications Commission, the National Telecommunications and Information Administration, the Secretary of Agriculture, and the Appalachian Regional Commission for data on existing service and other federal projects in the area. For projects by partnerships or consortia, property bought or improved with grant money must be held by a public partner or eligible nonprofit for the project's useful life, then can be transferred to partners under rules. Companies are not barred from competing just because they helped design the project. The Secretary can allow an option to sell project property to a third party only after the federal interest is released, and may count the present value of long-term contributions toward the non-Federal share if proper assurances are provided.
