Title 42 › CHAPTER 41 — DEMONSTRATION CITIES AND METROPOLITAN DEVELOPMENT PROGRAM › SUBCHAPTER II — PLANNED AREAWIDE DEVELOPMENT › § 3335
The Secretary can give extra federal money to state or local public bodies or agencies that are carrying out, or helping carry out, areawide development projects if those projects meet certain tests. The area must have a strong, area-wide plan that helps decide where, when, and how to build public facilities (like hospitals, water systems, roads, transit, airports, parks) and how to guide big land uses that affect the whole area. There must be real ways to coordinate local policies and actions under that plan. The projects and major land uses must actually follow the plan. A local government applying must show it is making sure projects follow the plan, including by scheduling projects and using zoning or subdivision rules. If a nonlocal agency applies, both it and the local government where the project is must meet these rules. The Secretary must get and consider comments from the planning bodies responsible for the area. No grant may be made for a project that already got federal help under the other federal program named in section 3338(2) before February 21, 1966, or more than one year before the Secretary’s determinations. If such a contract was made after June 30, 1967, the grant application must be filed on or before the contract date. The Secretary cannot require a community to adopt a program to create or remove racial balance in school districts as a condition for these funds.
