Title 42 › CHAPTER 44 — DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT › § 3537a
HUD workers must not knowingly tell anyone about nonpublic information on who will get HUD money while choices are being made, except to people the Secretary has allowed. If the Secretary has reason to think someone broke this rule, the Secretary must act. If winners have not yet been picked, the Secretary may stop the selection or take other steps. If a winner was already picked, the Secretary may cancel that choice, punish the violating applicant, let the applicant stay in the program, or do something else. People affected may get a hearing when the Secretary’s rules require it. If a HUD employee knowingly and in a significant way breaks the rule, the Secretary may fine the employee up to $10,000 for each violation, in addition to other civil or criminal actions. The Secretary must set procedures, give the employee a chance for a hearing, and make a penalty final if no hearing is asked for within 15 days after notice. After using all internal steps, an employee can ask the U.S. court of appeals to review the penalty within 20 days. The Secretary may review orders within 90 days. Penalties can be settled or reduced and are sent to the U.S. Treasury. Willful disclosure to an applicant or their representatives can also bring up to 5 years in prison, a fine, or both. The Secretary must write rules to carry this out. These rules cover violations that happen on or after December 15, 1989. Definitions: Applicant — someone being considered for aid; Assistance — competitive grants, loans, subsidies, guarantees, or similar financial help from HUD (not mortgage insurance); Covered selection information — application details or decision information HUD keeps private; Knowingly — actual knowledge, deliberate ignorance, or reckless disregard; Selection — choosing who gets aid; Selection process — the whole period from making the application request through picking recipients, including review.
