Title 42 › CHAPTER 50 — NATIONAL FLOOD INSURANCE › SUBCHAPTER IV — GENERAL PROVISIONS › § 4121
Defines key words used in this chapter and explains what counts as a "flood." The word "flood" can be set by the FEMA Administrator and can cover water rising or overflowing from rivers, seas, storms, tsunamis, hurricanes, and similar events. It also includes mudslides caused by water on or under the ground and shoreline collapse or sinking from erosion by waves or currents above normal levels. FEMA may issue rules to treat those mudslides and collapses the same way as other floods. Key terms and short meanings: "United States/State" — includes the States, District of Columbia, territories and possessions, Commonwealth of Puerto Rico, and the Trust Territory of the Pacific Islands. "Insurance company/other insurer/insurance agent or broker" — any person or group allowed to sell or take on insurance under state law, including those reporting under the Securities Exchange Act or authorized by FEMA to take reinsurance. "Insurance adjustment organization" — people or groups who handle insurance loss claims. "Person" — an individual, group, company, government, or other organized group. "Administrator" — the FEMA Administrator. "Repetitive loss structure" — a building with flood insurance that had flood damage on 2 occasions where repairs each time averaged at least 25 percent of the building’s value, and whose policy included increased cost of compliance at the second damage. "Federal agency lender" — a federal agency making direct loans secured by improved real estate or a mobile home. "Federal entity for lending regulation" — the listed federal banking regulators or the one that mainly supervises a given lender. "Improved real estate" — land with a building on it. "Lender" — a regulated lending institution or a federal agency lender. "Natural and beneficial floodplain functions" — the natural ways an undisturbed floodplain reduces flooding, erosion, and damage and helps water quality and groundwater recharge. "Regulated lending institution" — banks, savings and loans, credit unions, farm credit banks, Federal land bank associations, production credit associations, or similar institutions supervised by a federal regulator. "Servicer" — the person who collects a borrower’s scheduled payments and makes loan-related payments. "Substantially damaged structure" — a building with flood insurance whose repair costs exceed an amount set by FEMA rules or by a community ordinance, whichever is lower.
