Title 42 › CHAPTER 50 — NATIONAL FLOOD INSURANCE › SUBCHAPTER IV — GENERAL PROVISIONS › § 4131
Require the Secretary to make sure at least one activity in the Corps of Engineers’ levee and dam safety programs gives enough information for the Secretary to decide on levee accreditation under section 65.10 of title 44, Code of Federal Regulations (or any replacement rule). The Secretary must, as much as possible, follow the timing used by the National Flood Insurance Program. If the Corps operates and maintains a levee, the Secretary should work with local governments to provide information needed for accreditation quickly. If a non-Federal group asks, the Secretary may do an earlier levee evaluation for the National Flood Insurance Program than would otherwise happen. Any such evaluation must meet section 65.10 as it was on June 10, 2014, and follow procedures the Secretary sets after talking with the FEMA Administrator. The Secretary may use funds under section 1962d–16 to pay for these evaluations, must apply the cost share rules in section 1962d–16(b), and a non-Federal group may pay up to 100 percent of the cost.
