Title 42 › CHAPTER 55 — NATIONAL ENVIRONMENTAL POLICY › SUBCHAPTER I — POLICIES AND GOALS › § 4336a
Federal agencies must pick one lead agency when more than one federal agency works on the same project. The agencies choose the lead by a letter or memo based on who is most involved, who can approve the project, who has the right expertise, how long they will be involved, and the order in which they get involved. They can name state, Tribal, or local governments to share the lead. The lead agency runs the environmental review, invites other agencies to help early, considers their work, sets a schedule with those agencies and the applicant, warns other agencies if the schedule will slip, and meets with them if asked. Other agencies with legal authority or special knowledge can be named cooperating agencies and must send comments by the schedule. If no lead is picked and someone is hurt by that, they can ask a participating agency to pick one. If agencies can’t agree in 45 days, that person can ask the Council to pick a lead; agencies may respond in 20 days, and the Council must decide within 40 days. Reviews should be done in one document when possible, include a short purpose-and-need statement, ask the public for input, and follow page limits: environmental impact statements 150 pages (300 if very complex), environmental assessments 75 pages. A lead agency must finish an environmental impact statement within 2 years and an environmental assessment within 1 year, measured from the earliest of three trigger events (agency decision that the document is needed, notice the application is complete, or a notice of intent). Deadlines can be extended only as needed with the applicant’s input. A project sponsor can ask a court to enforce a missed deadline; the court must set a new schedule, normally no more than 90 days. Each lead agency must yearly report missed deadlines and explain them, naming the office responsible, key dates, and when the review is expected to finish.
