Title 42 › CHAPTER 61 — UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES FOR FEDERAL AND FEDERALLY ASSISTED PROGRAMS › SUBCHAPTER I — GENERAL PROVISIONS › § 4605
People who are not lawfully in the United States cannot get relocation payments or other help under this program, except in a narrow hardship case. The lead agency had to make rules within 1 year after November 21, 1997, after giving notice and a chance for public comment. Those rules must say how agencies check a person’s immigration status, ban discrimination, require fair decisions based on reliable information, and set standards for finding "exceptional and extremely unusual hardship." If an agency finds by clear and convincing evidence that denying help would cause exceptional and extremely unusual hardship to the displaced person’s spouse, parent, or child who is a U.S. citizen or a lawful permanent resident, the agency must give the payments and other assistance if the displaced person would otherwise qualify. This does not affect any rights the person has under other federal or state laws.
