Title 42 › CHAPTER 61 — UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES FOR FEDERAL AND FEDERALLY ASSISTED PROGRAMS › SUBCHAPTER II — UNIFORM RELOCATION ASSISTANCE › § 4622
When a federal agency’s project forces someone to move, the agency must pay certain moving and restart costs. It must cover reasonable actual moving expenses for people, families, businesses, farms, or personal property; actual direct losses of tangible property caused by moving or closing a business or farm (but not more than what it would cost to move that property); reasonable costs to look for a replacement business or farm; and reasonable costs to reestablish a farm, nonprofit, or small business at a new site, up to $25,000 (this limit can be changed by regulation under section 4633(d)). If a person is moved from a home, they may choose an expense and dislocation payment set by the lead agency. If a person is moved from a business or farm, they may choose a fixed payment instead of the above benefits, if they meet agency rules; that fixed payment must be at least $1,000 and no more than $40,000 (adjustable by regulation). A person whose only business at a moved dwelling is renting that dwelling does not qualify for the business fixed payment. The agency may also pay a utility owner for extra costs of moving a utility facility when the project did not aim to move the utility, the utility has a franchise or similar agreement with the state or local government where the facility sits, and the move causes extraordinary costs. Any payment cannot be more than those extra costs minus any increase in value of the new facility and minus salvage value from the old one. Extraordinary cost: a non-routine relocation expense not normally in the owner’s annual budget, as the agency defines. Utility facility: systems like electric, gas, water, steam, materials or transport lines, communications (including cable), and related equipment on state or local government land or easements.
