Title 42 › CHAPTER 61 — UNIFORM RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION POLICIES FOR FEDERAL AND FEDERALLY ASSISTED PROGRAMS › SUBCHAPTER III — UNIFORM REAL PROPERTY ACQUISITION POLICY › § 4655
Federal agency heads must not approve any program, project, grant, contract, or agreement using federal money to buy real property on or after January 2, 1971, unless the agency getting the property gives clear assurances that it will follow the land acquisition rules in sections 4651 and 4652 as much as state law allows, and that property owners will be paid or reimbursed for necessary expenses as described in sections 4653 and 4654. An "acquiring agency" means a State agency that can use eminent domain under state law (see section 4601(3)). It can also mean a State agency or person that cannot use eminent domain when the lead federal agency allows that by regulation.
