Title 42 › CHAPTER 63 — LEAD-BASED PAINT POISONING PREVENTION › SUBCHAPTER V — GENERAL PROVISIONS › § 4841
Defines key words used in the chapter. "State" means the 50 states, the District of Columbia, the Commonwealth of Puerto Rico, and U.S. territories and possessions. "Units of general local government" means cities, counties, towns and other local governments, any group of them across states, Indian tribes, and, for lead-paint cleanup in cities, U.S. territories and possessions. "Lead-based paint" normally means paint that has more than 0.5% lead by weight in its non-evaporating part or in the dried film. The Consumer Product Safety Commission was given six months from the date the National Health Promotion and Disease Prevention Act of 1976 became law to decide, after hearings and expert advice, whether a different safe level greater than 0.06% but not over 0.5% should apply. If the Commission set a different level, that new level applies to paint made after the six-month period after the Commission’s decision. If the Commission did not act, then paint made after 12 months from the Act’s enactment with more than 0.06% lead is treated as lead-based.
