Title 42 › CHAPTER 65 — NOISE CONTROL › § 4912
Manufacturers whose products are covered by rules under sections 4905 or 4907 must keep records, run tests, and give reports or other information the Administrator reasonably asks for to check compliance. They must let a designated agency official see and copy those records at reasonable times. If the Administrator’s rules require it, manufacturers must also make items they just finished or otherwise have available for testing. Information that includes trade secrets or similar protected material is treated as confidential under federal law, but may be shared with other federal employees who must keep it confidential or when it is needed in a proceeding under this chapter. The Administrator cannot refuse to give information to authorized Congressional committees. Anyone who knowingly lies, falsifies records, tampers with required monitors, or makes inaccurate reports can be fined up to $10,000, jailed for up to six months, or both.
