Title 42 › CHAPTER 68 — DISASTER RELIEF › SUBCHAPTER II — DISASTER PREPAREDNESS AND MITIGATION ASSISTANCE › § 5136
The President must keep a public program that maps natural hazard risk for the whole United States and keeps those products up to date. Definitions: community disaster resilience zone — a census tract the President picks; eligible entity — a State, an Indian tribal government, or a local government. The maps and data must show risk and give ratings for loss exposure (like people, buildings, and farms), social vulnerability, community resilience, and any other items the President adds. Within 30 days after the President updates those products as required, and at least every 5 years after that, the President must pick community disaster resilience zones. Those will include the 50 census tracts with the highest individual hazard risk and, in each State, at least 1 percent of census tracts with high risk ratings (while aiming for coastal, inland, urban, suburban, rural balance and including Tribal lands). The risk ratings must use an assessment that looks at the intersection of loss to people, building value, and agriculture value, along with high social vulnerability, low community resilience, and the main natural hazards for the tract. Not later than 180 days after December 20, 2022, and every 5 years after, the President must review the methods, get public input, consider adding new data (such as recent census data, housing and income info, development and mitigation info, climate effects, and FEMA tools), publish changes, and update the products. The President must consult agencies like FEMA, USDA/Forest Service, NOAA/Census, DOD/Army Corps, EPA, Interior/USGS, HUD, and FHFA. For projects in these zones, the federal share of costs may be raised to as much as 90 percent, planning help and funds can be provided, applications (if required) must be reviewed within 120 days for whether they reduce harm and increase resilience, and certified projects that displace residents must offer comparable housing, voluntary acquisitions restricted to mitigation use, and strong public participation.
