Title 42 › CHAPTER 69 — COMMUNITY DEVELOPMENT › § 5323
Creates a competitive grant program to give money to groups that build or improve manufactured housing communities. Grants can pay for things like community infrastructure, utilities, rebuilding or replacing homes, planning, health and safety upgrades, buying land or sites, resident services (for example help with moving, avoiding eviction, or down payments), and other Secretary-approved activities that improve living conditions and keep places affordable. Grants cannot be used to rehab homes built before June 15, 1976, but can pay to replace those homes if the new homes meet the federal construction and safety rules or another type allowed by the Secretary. The Secretary must give priority to projects that mostly help low- and moderate-income residents and keep housing affordable long term. The Secretary can waive some related rules except those about fair housing, nondiscrimination, labor standards, and the environment. The Secretary will set and publish rules for choosing grantees and may reserve some funds for Indian tribes, tribally designated housing entities, and the Department of Hawaiian Home Lands. The program ends 7 years after July 11, 2026. Defined terms (one line each): community development financial institution — a Treasury-certified CDFI; eligible manufactured housing community — a mostly resident-owned or committed-to-affordable community affordable up to 120% of area median income; eligible recipient — entities like resident groups, local governments, housing authorities, nonprofits, CDFIs, tribes, states, or owner-operators working with communities; Indian tribe and tribally designated housing entity — as defined in title 25; manufactured housing community — a land area meant mainly for permanent manufactured homes; resident health, safety, and accessibility activities — work to protect health, save energy, or improve accessibility.
