Title 42 › CHAPTER 70 — MANUFACTURED HOME CONSTRUCTION AND SAFETY STANDARDS › § 5405
If an order could hurt you, you can ask the U.S. court of appeals where you live or have your main business to review it. You must file your petition within 60 days after the order is issued. The court will send a copy to the Secretary, and the Secretary must file the record of the case with the court. If you want to add new evidence, you can ask the court. If the court agrees the evidence is important and there was a good reason it wasn’t shown earlier, the court can have that evidence taken before the Secretary. The Secretary can change or add findings based on the new evidence and must file those changes with the record. The court can review the order and give relief, and its judgment is final unless the Supreme Court takes the case. The case continues even if the Secretary changes, and these review rights are extra to any other legal remedies. Anyone interested can get a certified copy of the case transcript from the Secretary if they ask and pay the copying cost. That certified copy can be used in criminal, import, or other proceedings under this law, even if court review hasn’t been started or finished.
