Title 42 › CHAPTER 70 — MANUFACTURED HOME CONSTRUCTION AND SAFETY STANDARDS › § 5413
The Secretary can inspect and investigate factories, warehouses, records, and other places where manufactured homes are made, stored, or sold. The Secretary must give the Attorney General and, when needed, the Secretary of the Treasury any information that shows someone is not following the Federal manufactured home construction and safety rules. People the Secretary names may enter those places at reasonable times without warning, show ID, and inspect buildings, documents, and records. The Secretary can hire state or local governments or private groups to help. The Secretary can hold hearings, take sworn testimony, require witnesses and documents by subpoena, copy evidence, order written reports under oath, get help and information from other Federal agencies, and tell the public about defects or noncompliance if it helps safety. Trade secrets and information that would cause serious competitive harm are kept confidential unless needed for enforcing the rules. Manufacturers must send building plans for every model to the Secretary or a designee and must certify that the plans meet the Federal standards before making the model. Manufacturers, distributors, and retailers must keep records, file reports, and give information the Secretary reasonably asks for, and must let authorized people inspect relevant books and papers. Manufacturers must also provide performance and test data the Secretary requires and must give that data to prospective buyers before the first sale (for purposes other than resale) and to the first buyer at purchase or in printed material left in the home. Confidential trade secret information may be shared only with staff working on these rules or in related legal proceedings, and Congress’s proper committees may get the information.
