Title 42 › CHAPTER 74 — NONNUCLEAR ENERGY RESEARCH AND DEVELOPMENT › § 5907
Allows the Secretary to find ways to speed up putting new energy technologies into commercial use and to give federal help or take part in demonstration projects like pilot plants, field tests, and prototype or full-scale trials. The Secretary can make cooperative agreements with nonfederal partners to show whether a technology works and has economic promise. When choosing projects, the Secretary must look at the expected goals, the economic, environmental, and social importance, how the proposal fits existing priorities, whether nonfederal partners and money are available, total cost and schedule, who will take part and pay, and how the project will be managed. Federal money can only pay the federal share of design, construction, operation, and maintenance. Nonfederal shares can be land, property, services, or other contributions whose value the Secretary decides. The Administrator had to issue rules within six months of December 31, 1974, setting procedures for proposals and selection, and those rules must say what information a proposal should include (technology, prior pilot experience, plant design, timetables, cost estimates, site and resource info, environmental impact and waste plans, plans for commercial use, continued use, or dismantling). The Secretary must review and update those rules as needed. If the federal construction cost is estimated above $50,000,000, Congress must specifically authorize any appropriation. If the federal share is $50,000,000 or less, the Secretary can move forward if funds are available; but if it is estimated above $25,000,000 the Secretary must send a full report to the appropriate Congressional committees and wait 60 calendar days (excluding certain long adjournments) after Congress receives the report before spending funds. The report must analyze how the proposal meets the selection criteria.
