Title 42 › CHAPTER 77 — ENERGY CONSERVATION › SUBCHAPTER III — IMPROVING ENERGY EFFICIENCY › Part A — Energy Conservation Program for Consumer Products Other Than Automobiles › § 6296
Put clear labels on covered products and show them where the rule says. If a product is sold from a catalog, the catalog must include the same label information unless the catalog began being distributed before the labeling rule took effect. Within 60 days after a labeling rule starts, manufacturers must tell the Secretary or the Commission which current models are covered and give the starting serial numbers. Before making any new model, they must notify the Secretary or Commission and give the starting serial number. If asked, manufacturers must give the data used to create the label within 30 days and keep that data for the time the rule requires. If the Secretary or the Commission asks for products to test for compliance or accuracy, manufacturers must supply a reasonable number of units at their own cost; lab charges may be paid by the United States only if Congress provides the funds. Each year, at a time set by the Commission, manufacturers must send the Commission energy- or water-use data from the required tests. The rules may also require manufacturers to let a Commission or Secretary representative watch testing and see the results. Use labels that reflect revised range tables within 60 days after those tables are published, unless a later date is allowed. The Commission cannot order label changes more than once a year. The Secretary can require manufacturers to submit information or reports about energy use, water use (for certain products), and economic impacts to set or change test methods, labels, and standards, and to check compliance. The Secretary must try to keep these requests from being unnecessarily burdensome and consider existing public sources. Information provided is handled under the same rules that apply to similar energy information in title 15.
