Title 42 › CHAPTER 79 — SCIENCE AND TECHNOLOGY POLICY, ORGANIZATION AND PRIORITIES › SUBCHAPTER I — NATIONAL SCIENCE, ENGINEERING, AND TECHNOLOGY POLICY AND PRIORITIES › § 6605
Federal research agencies must require every applicant to list, for each covered individual on the application, the amount, type, and source of all current and pending research support the person has or expects to get. Each covered individual must say the information is accurate and agree to update it if the agency asks. An applying organization must confirm that its listed covered individuals know about these rules. The Office of Science and Technology Policy must make sure agencies use consistent requirements. If someone knowingly fails to disclose required support, an agency can reject the application, stop or end funding, pause or cut off future funding, suspend or bar the person or organization under part 180 of title 2, Code of Federal Regulations, refer the matter to the agency Inspector General or law enforcement, report the problem in the Federal Awardee Performance and Integrity Information System, or take other allowed actions. An agency can act against an organization only if the organization failed to inform its people, knew about a person’s nondisclosure and did not fix it, or is controlled by a person who failed to disclose. Agencies must tell people why they plan to act and give them a chance to challenge it. Definitions (one line each): covered individual — someone who makes a meaningful research contribution and is so designated; current and pending research support — all resources, monetary or not, domestic or foreign, that support a person’s research; entity — an applicant or award recipient; Federal research agency — any agency with over $100,000,000 in yearly extramural research spending; research and development award — R&D support like grants, contracts, or cooperative agreements, not routine procurement.
